1. Acceptance of Terms

By accessing or using the Services, you agree to comply with this Agreement and all applicable laws and regulations. If you are entering into this Agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms. We reserve the right to update or modify these Terms at any time without prior notice. The updated date at the top of this page will indicate when the last changes were made. Continued use of our Services after changes are posted constitutes acceptance of the revised Terms.

2. Eligibility and Device Compatibility

To use our Services, you must be at least 18 years old or the legal age of majority in your jurisdiction, and have the legal capacity to enter into binding contracts.

Device Verification: It is your sole responsibility to ensure that your mobile device is carrier-unlocked and compatible with eSIM technology before purchasing a plan. eSIM technology requires specific hardware support. By completing a purchase, you represent and warrant that you have verified compatibility using our eSIM Guide or by checking your device manufacturer's technical specifications. eSIM Air LLC will not be held liable for purchases made for incompatible or carrier-locked devices, and such purchases are strictly ineligible for refunds.

3. Purchases and Order Fulfillment

eSIM Packages: We offer prepaid eSIM profiles loaded with specific data allowances and validity periods for use in designated countries and regions.

Order Acceptance: All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order for any reason, including but not limited to carrier network limitations, pricing errors, fraudulent activity, or system restrictions.

Fulfillment: Upon successful checkout, your digital eSIM profile will be instantly generated and delivered to the email address provided during the checkout process as a scan-ready QR code. No physical goods will be shipped.

4. Payments and Pricing

All prices displayed on our storefront are shown in United States Dollars (USD) and are inclusive of any applicable indirect taxes and transaction fees, unless stated otherwise.

Payment Terms: Payment must be made in full at the time of purchase using our authorized payment gateways (including Chargily Pay integration). You represent and warrant that you are authorized to use the chosen payment method. In the event of a transaction dispute or authorization failure, we reserve the right to immediately suspend or terminate access to the associated eSIM profile.

5. eSIM Activation and Usage

Activation: The installation of an eSIM profile requires a stable Wi-Fi or cellular network connection. We recommend installing the profile before departing on your trip.

Validity and Expiry: Each prepaid plan has a defined validity period (e.g., 7 days, 15 days, 30 days) and data allotment. The plan's validity clock begins automatically when the eSIM first connects to an authorized partner network at your travel destination, not at the time of purchase. Once the data allowance is fully consumed or the validity period expires, the network connection will automatically terminate. We do not support automatic renewals, overages, or recursive billing; any additional data requires purchasing a new plan or a top-up profile.

6. Refund Policy Overview

Refund requests are subject to the terms of our official Refund Policy. Because eSIM profiles are digital assets delivered instantly, refunds are strictly limited to cases where technical failures prevent activation or connection, and our support team has had a reasonable opportunity to troubleshoot the issue.

Refunds will not be issued for used data, partial validity, device incompatibility, locked devices, or simple change of mind after the eSIM QR code has been generated.

7. Service Limitations and Availability

Our cellular data services are delivered via roaming agreements with global network operators. Connectivity and speed are subject to transmission limitations, network coverage, signal strength, terrain, weather, atmospheric conditions, and local carrier traffic management policies (including Fair Use Policies).

We do not guarantee uninterrupted, error-free, or 100% available network connections. Speeds may vary between 3G, 4G, and 5G depending on local partner availability.

8. Termination of Service

We reserve the right to terminate, suspend, or restrict your access to all or part of the Services, including disabling your active eSIM profiles, without notice, if we determine in our sole discretion that you have:

• Violated these Terms of Service;
• Used the data connection for illegal, abusive, or unauthorized purposes;
• Attempted to resell or commercially exploit our eSIM profiles;
• Caused harm, disruption, or network degradation to our upstream carrier network partners.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall eSIM Air LLC, its affiliates, directors, employees, or upstream carrier suppliers be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of or inability to use the Services.

In all circumstances, our maximum aggregate liability for any claims, disputes, or losses shall not exceed the total amount paid by you to eSIM Air LLC for the specific eSIM plan that is the subject of the dispute.

10. Intellectual Property Rights

All content, brand assets, logos, design marks, graphics, user interfaces, software, and text on this website are the exclusive intellectual property of eSIM Air LLC or its licensors and are protected by copyright, trademark, and other proprietary laws. You are granted a limited, non-exclusive, non-transferable license to access our platform solely for personal, non-commercial purposes.

11. Governing Law and Jurisdiction

These Terms, and all disputes arising out of or relating to them, shall be governed by and construed in accordance with the laws of the jurisdiction in which eSIM Air LLC is registered, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in that jurisdiction, and you hereby consent to the personal jurisdiction and venue of such courts.
